SofTMware® - Privacy Policy v0.1 Last Revised 2/26/2017
This document is our Privacy Policy. It states what information we collect from users of the SofTMware® services and website (the “Services”) and how we use and disclose that information.

Information Collection: In general, we prefer not to gather information about you that isn’t required for the proper functioning of the Services.
Required Account Information: When you create an account, you will be required to provide a valid email address and a password. You will use the email address and password to log into your account when you use the Services. In the even you forget your password, we will send you a link via your email address to reset your password. In addition, we may use the email address to notify you of important changes to the Services, the Terms of Service, and this Privacy Policy. If you choose, you may also elect to receive periodic email updates regarding status changes for trademark applications and registrations you are tracking through the Services. Finally, we may contact you from time to time to inquire about your experience and satisfaction with the Services. You may update or change your account information at any time by logging into SofTMware and visiting the “My Account” tab.
Optional Account Information: You also have the option to provide your First Name, Last Name, and Phone Number. If provided, we may use this information to contact you to inquire about your experience and satisfaction with the Services. In addition, you may designate up to four additional email addresses to which daily update emails may be sent. By providing these email addresses, you represent that each of the respective recipients have consented to being sent the daily update reports associated with your account.
Application/Registration Information: As you use the Services, you have the option to provide trademark application serial numbers corresponding to U.S. trademark applications and registrations you wish to monitor through the Services. These serial numbers are necessarily stored by the Services and associated with your account in order to display information about the corresponding applications and registrations at the USPTO. However, EMP&A personnel do not monitor the serial numbers provided to the Services or the accounts with which they are associated.
In addition, you may designate customized category tags to organize the application serial numbers associated with your account. Again, though these tags are stored by the Services, EMP&A personnel do not monitor the content of customized tags or the serial numbers or accounts with which they are associated.
Notwithstanding the above, EMP&A strongly recommends that users avoid submitting any confidential or privileged information to the services.

Information Disclosure: Except as otherwise provided below, we do not share any information you submit to the Services with any unrelated third parties.

Your information may be subject to disclosure pursuant to judicial or other government subpoenas, warrants, or orders. Accordingly, we may access, preserve, or disclose your information if we believe it is necessary to comply with legal process.

Your information may be accessed by some EMP&A personnel and contractors for the purposes of responding to your customer service inquiries, ensuring the proper functioning of the Services, and/or improving and updating the Services. We require that all such personnel and contractors agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

In the event that the Services or EMP&A are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

Changes to the Privacy Policy
We will occasionally update this Privacy Policy to reflect changes in our Services and policies. When we post changes to this Privacy Policy, we will revise the “last revised” date at the top of this statement. If there are material changes to this statement, or material changes in the way we use your information, we will notify you prior to implementing they either by prominently posting a notice of such changes or by sending you a notification of the changes via email. We encourage you to periodically review this Privacy Policy to stay informed about how the Services collect and use your information.
